Commercial Advisory

Procurement, contracting and delivery: strategy and negotiation through to variations and claims.

The position

By connecting commercial advice with project controls and delivery evidence, we help clients protect their position and pursue practical outcomes, rather than arguing a position the program record will not support.

The aim is always to resolve the commercial issue while the project is still running. Dispute avoidance is cheaper, faster and better for the relationship than dispute resolution.

Contract strategy that protects value

A contract is a risk allocation decision before it is a legal document. We help clients decide what to carry, what to transfer and what to price, then make sure the contract actually says that.

During delivery we keep the commercial position tied to the delivery record (the program, the site evidence and the correspondence), so entitlement can be demonstrated, not just asserted.

How support is structured

  1. At the front end

Shaping procurement and contract strategy so risk sits where it can actually be managed.

  2. During delivery

When the contract meets conditions nobody drafted for, and the position has to be protected as it moves.

  3. Before it becomes a dispute

Resolving the commercial issue while the project is still running, on evidence the program record will support.

Our process

How we work

Our approach keeps advice focused on the decisions that matter, from establishing the current position through to implementing and monitoring the response.

  1. Engage & Define

We establish the client's objectives, delivery environment and key concerns, then define a focused scope, required information and expected outcomes.

  2. Assess & Diagnose

We review the available evidence, test the quality of information and challenge assumptions to identify the underlying causes and consequences of the issue.

  3. Advise & Prioritise

We provide a clear view of the current position, emerging risks and available options, prioritising recommendations by urgency and commercial impact.

  4. Implement & Monitor

Where required, we support implementation, monitor performance and adjust the response as project conditions change.

Frequently Asked Questions

What contract types do you support?
The standard Australian suite (AS 4000 and AS 4902, GC21, PSC and the major alliance and D&C forms), plus bespoke and amended contracts, which in practice is most of what large programs run on.
Do you manage variations directly?
We can. Depending on the engagement we either prepare and manage variations and claims on your behalf, or advise your commercial team and review their position before it is submitted.
Can you support procurement from the outset?
Yes, and that is where we add the most value. Decisions made in procurement and contract strategy set the commercial risk profile for the whole delivery phase.
